Chapter 4: The Hearing
When the court reconvened, the judge looked directly at the mother.
“Mrs. Cole, you have been absent from your children’s lives for five years. You provided no support, no contact, and no explanation. Can you explain why you believe you are now fit to resume custody?”
The mother’s smile never wavered.
“I was in a difficult situation. I needed time to get back on my feet. Now I’m stable and ready to be their mother again.”
Matthew couldn’t stay silent.
“You left us with no food and no money. You never called. You never wrote. You disappeared. And now you want them back because it’s convenient?”
The judge allowed him to speak.
Sammy’s hand tightened in his.
The mother’s attorney tried to object, but the judge silenced him.
Matthew continued, voice steady.
“I have worked every day since she left. I have a home ready for Sammy. I have never given up on him. She gave up on both of us the day she walked out.”
The judge turned to Sammy.
“Sammy, would you like to tell me what you want?”
Sammy looked at his mother, then at Matthew, then at the judge.
“I want to go home with my brother.”
The courtroom was silent.
The judge nodded.
“Based on the evidence, the stability provided by the older brother, and the child’s expressed wishes, custody is granted to Matthew Cole with the state providing transitional support.”
Matthew felt the weight of five years lift from his shoulders.
Sammy threw his arms around him and cried.
Their mother stood up, face tight with anger, but the judge had already made her decision.
