Chapter 10: Advancing Record

By the end of the first month the legal record had hardened against every attempt to soften it.
The assault charges proceeded on the clear strength of the smoke-detector footage, the medical documentation, and the consistent statements. Derek’s early claim of a temporary argument that escalated failed against the timestamped audio of him forcing me out of bed and Marlene laughing in the doorway while instructing me to learn who owned the house. The financial case expanded in parallel as the forensic review confirmed the full path of the nearly four million dollars moved through layered invoices and unauthorized transfers into accounts tied to Marlene.
Recovery actions were filed. Temporary restraining orders on remaining assets held. The forged voting-authorization document underwent formal signature analysis and was marked as non-authentic. Derek’s operational control of the construction company, built on that forgery, was treated as void from the relevant date forward. Court-supervised management protocols kept legitimate company functions running while the extracted funds were traced and pursued.
Elena managed the sequence without theatrics. She provided me with clear summaries and required decisions only when necessary. I reviewed each summary the same way I had once reviewed audit packages: for gaps, for contradictions, and for the next required pressure point. There were few gaps left.

Derek’s attorneys shifted focus toward mitigation, emphasizing my grief after my father’s death and suggesting that the two-year delay in reporting indicated confusion rather than calculated theft on their part. Elena answered with the six-week period of active evidence collection, the independent camera installation, the quiet account freeze, and the final recorded attempt to remove physical evidence on the morning of the arrests. Delay in reporting, when paired with contemporaneous documentation, is not confusion. It is preparation.
Marlene’s separate defense attempted to distance her from the transfers. The account records and the morning footage of her carrying the portable drive made distance impossible.
