Chapter 4: The First Words
After a short recess, the judge called everyone back into the courtroom.
Lily was brought back in, this time sitting beside a kind-looking child advocate. She still held her stuffed rabbit tightly, but she looked a little calmer.
Judge Whitman spoke gently to her.
“Lily, can you tell us what happened at home? It’s okay. You’re safe here.”
Lily looked at David for a second, then quickly looked away. She hugged her rabbit closer to her chest.
“Daddy and Jessica live together now,” she said in a small voice. “Mommy doesn’t live with us anymore. She moved away.”
The judge nodded.
“What about when you’re with Daddy and Jessica?”
Lily was quiet for a moment.
Then she said, “Jessica gets mad a lot. When I make noise or when I ask about my real mommy, she gets really angry. She yells at me. Sometimes she hits my arm or my leg. Daddy tells her to stop, but he doesn’t really stop her. He just goes to another room.”
Elena felt tears sting her eyes.
David looked like he wanted to crawl under the table.
Lily continued, her voice getting smaller.
“One time, Jessica locked me in my room because I wouldn’t stop crying. She said if I kept crying, she would throw my rabbit away. I love my rabbit. His name is Mr. Hoppy.”
She held up the worn stuffed rabbit for everyone to see.
The entire courtroom was silent.
Judge Whitman’s voice was gentle but firm.
“Lily, has anyone ever hurt you badly?”
Lily nodded.
“Jessica hits me sometimes when Daddy isn’t looking. And one time, she pushed me really hard and I fell. My knee was bleeding. Daddy got mad at her, but then he told me not to tell anyone. He said people would take me away if I talked.”
David buried his face in his hands.
Jessica looked like she was about to bolt from the room.
Lily looked up at the judge with big, serious eyes.
“I don’t like living there anymore,” she said quietly. “I want to live with my real mommy. But Daddy said she doesn’t want me. He said she left because I was bad.”
Elena couldn’t hold back her tears anymore.
She had never even known this little girl existed… but hearing her say those words broke something inside her.
Judge Whitman looked at David with pure disgust.
“Mr. Caldwell,” she said, “do you have anything to say in your defense?”
David slowly lifted his head.
His eyes were red.
He looked at Lily, then at Elena, then back at the judge.
“I… I messed up,” he said hoarsely. “I didn’t know how to handle everything. Jessica and I… we fought a lot. Sometimes things got out of hand. But I never meant to hurt Lily. I swear.”
Judge Whitman stared at him for a long moment.
Then she spoke.
“Given the serious nature of these allegations and the child’s own testimony, I am placing Lily Caldwell in temporary protective custody with Child Protective Services. A full investigation will be conducted immediately. Mr. Caldwell, you are to have no contact with the child until further notice from this court.”
She turned to Jessica.
“Ms. Price, you are also ordered to stay away from Lily Caldwell.”
Jessica looked like she was about to faint.
David just sat there, staring at the table, looking completely defeated.
Elena wiped her tears and placed both hands on her belly.
For the first time in a long time, she felt like justice might actually be possible.
